Banks must now open special accounts for clients placed in rehabilitation, external management or liquidation under the Insolvency Law. Debit operations on their old accounts stop, and the money is moved to the new special account.
The changes were made by the Central Bank Board resolution of 16 October 2026 No. 24/21. It was registered by the Ministry of Justice on 20 October 2026 under No. 3420-3 and entered into force on 21 October 2026. It amends the Instruction on opening, maintaining and closing bank accounts (reg. No. 3420).
The bank that services the client's main account opens it on presentation of a document introducing the procedure:
In pre-court and court rehabilitation, funds are spent on the client's payment order. In external management and liquidation, they are spent on the order of the court-appointed manager. The general rules on writing off funds from the accounts of business entities do not apply to these special accounts.
What this means in practice. If your counterparty is in rehabilitation or liquidation, do not count on collection by direct debit: the bank will return the document unexecuted. A business in rehabilitation should approach its bank early with the Agency decision or court ruling: its funds will be gathered in one account and spent on its own instructions.
